Terms & Conditions This Agreement is made between: Mix Artist Studio ("Studio"), located in Mullumbimby, NSW, represented by Jan Muths, and The Artist/Band ("Artist") submitting the application form, as well as all their associates who will be participating in the project and/or entering the studio property, including (but not limited to) other bandmates, managers, record company representatives, or other stakeholders. ​ELIGIBILITY The Artist must be of legal age to participate in the campaign. The Artist must be willing to have video footage, audio recordings, and behind-the-scenes content captured during the session for promotional and educational purposes. CAMPAIGN OFFER One selected Artist or Band will receive the opportunity to record and mix their project (single, EP, or album) at Mix Artist Studio at a 50% discount off the standard rates for recording and mixing services. The Artist agrees that there will be no cash equivalent under any circumstances. ​GRANT OF RIGHTS For transparency, the selection process will be shared on social media. By submitting your application, you grant Mix Artist Studio the right to use your application, including all associated or linked media, for the purpose of publicly showcasing the selection process. In exchange for the discounted recording and mixing services, the Artist grants Mix Artist Studio a perpetual, non-exclusive, royalty-free license to use, edit, reproduce, distribute, display, and publish the following materials: Video footage recorded during the session Audio recordings and files from the session Images and behind-the-scenes content from the session These materials may be used by Mix Artist Studio and its staff for: Promotional purposes, including social media, the studio’s website, advertisements, and print materials. Educational content, such as online courses, tutorials, and other instructional media. Other marketing and promotional purposes as determined by Mix Artist Studio. The Artist guarantees that they are the sole copyright owner of the music and that no external parties (such as record companies) limit the rights granted to the Studio under these terms and conditions. ARTIST'S RIGHTS & LIMITATIONS The Artist retains full copyright to their original compositions and performance rights. The Studio’s use of the content does not transfer ownership of the underlying musical work to the Studio. The Artist may use the sound recordings for commercial release and personal promotion, provided it does not conflict with the Studio’s commercial use. CONSIDERATION By participating in this campaign, the Artist acknowledges that they are receiving a discounted recording and mixing rate for the services provided. No additional payment, royalties, or compensation will be due to the Artist for the use of the recorded materials beyond the agreed-upon discount. ​WAIVER & RELEASE The Artist waives any right to inspect or approve the final versions of any media incorporating their performance. The Artist also releases Mix Artist Studio, its owners, employees, and representatives from any claims, demands, or liabilities related to the use of the materials as permitted under this Agreement. ​CONFIDENTIALITY & GOOD FAITH Mix Artist Studio agrees to handle all recorded materials professionally and in good faith. Any sensitive or private information disclosed during the sessions will remain confidential and will not be shared without prior consent. SELECTION PROCESS The Artist will be selected based on their eligibility and the quality of their musical performance and project proposal. The Studio reserves the right to choose the selected Artist based on the Artist’s alignment with the campaign’s goals.  ​GOVERNING LAW This Agreement is governed by the laws of New South Wales, Australia. Any disputes arising from this Agreement shall be resolved in the appropriate courts of NSW. ​AGREEMENT ACCEPTANCE By applying for this campaign, both the Artist and Mix Artist Studio acknowledge and agree to the terms outlined in this Agreement.
